What The Motor Block is
The Motor Block is an advertising marketplace run by The Motor Block LLC. Each vehicle is offered by the seller named on its listing, a licensed dealer or a private owner. A purchase is a contract between you and that seller; the seller handles payment, title and registration paperwork, and a dealer sale is on the dealer's purchase agreement. The Motor Block LLC does not own or sell the vehicles, does not negotiate or arrange sales, does not hold your money, and is not a dealer, broker, escrow or payment service. We check each car's title history before listing and pass your inquiry to the seller; everything after that is between you and the seller.
Prices and advertising
Dealer prices are plus government fees and taxes, any finance charges, any dealer document processing charge, any electronic filing charge, and any emission testing charge; private seller prices are asking prices and the buyer pays tax, title and registration at transfer. Each listing identifies the vehicle by model, model year and VIN and names the seller. We work to keep every listing accurate and withdraw sold vehicles promptly, but information comes from the vehicle's records and the seller, and errors can occur; confirm anything that matters to you with the seller before you buy, and inspect the car or have it inspected.
Vehicle history
Before a car is listed we run its VIN through Carfax and the federal NMVTIS title database and show you what we found. These reports depend on what has been reported to those databases and are not a guarantee of a vehicle's condition or history. A written odometer disclosure and the title documents are provided at the time of sale.
Listing a car with us
When you submit a car you confirm that you own it or are authorized to sell it, that the information and photos are accurate and yours to share, and that you will tell us about known accidents, damage, modifications, liens and title issues. Before a car goes live you sign a listing agreement that states the fees for that listing, the term, and what each side does; it is signed electronically on your phone and you receive a copy. You keep possession of the car, you sell it directly to the buyer, and you may withdraw an unsold car at any time under the terms of that agreement. Dealers that list here confirm they hold the license their state requires and that their advertising complies with their state's dealer advertising rules.
What we charge
Buyers pay The Motor Block nothing. Sellers pay the flat listing fee stated in their listing agreement, if any, and the price of optional services they choose. The Motor Block takes no commission on a sale and receives nothing from the buyer. We advertise; we do not arrange or negotiate sales.
Your account
Sign-in is by a one-time code sent to your email. Keep your email account secure; anything done through your sign-in is treated as done by you. Do not use the site to post false information, to harass anyone, or to attempt to access other people's data.
Content you post and copyright
Photos and text you submit remain yours. You give The Motor Block LLC a license to use them to list and market the vehicle, including in edited form and on partner marketplaces and social channels, until the car is sold or withdrawn, and to keep sold listings online as market history. Everything else on the site belongs to The Motor Block LLC. You are responsible for what you post. Do not post content you do not have the right to use, false statements about a vehicle, other people's personal information, or anything unlawful. We may edit or remove any listing or content at any time.
Copyright complaints: if you believe content on this site infringes your copyright, send a notice under 17 U.S.C. section 512(c) to our designated agent, DMCA Agent, The Motor Block LLC, by email at info@themotorblock.com, with the work claimed to be infringed, the location of the material on this site, your contact details, a statement of good faith belief, a statement under penalty of perjury that you are authorized to act, and your physical or electronic signature. We remove infringing material promptly and terminate the accounts of repeat infringers.
Disclaimers and limits
The site is provided as is. The Motor Block LLC is not a party to any vehicle sale and makes no warranty about any vehicle, seller or buyer. To the extent California law allows, The Motor Block LLC is not liable for indirect or consequential losses arising from use of the site or from any transaction between a buyer and a seller, and its total liability to you for any claim related to the site is limited to the fees you paid us in the prior 12 months or $100, whichever is greater. Nothing here limits a dealer's obligations to you under vehicle sales law or any right that cannot be waived.
Disputes
These terms are governed by California law. Talk to us first; most problems are solved in one email. Either side may bring a claim in small claims court. Any other dispute about the site is resolved by binding individual arbitration under the consumer rules of the American Arbitration Association, in Orange County, California or by video; class actions and class arbitrations are waived. You may opt out of arbitration by emailing info@themotorblock.com within 30 days of first using the site, in which case disputes go to the state or federal courts in Orange County, California. Nothing here limits your right to seek public injunctive relief where California law guarantees it. Disputes about a vehicle purchase are between the buyer and the seller.
